I. Conclusion of contracts

1. 1. The interested party shall express interest in concluding a travel contract by completing and sending a non-binding application on the website with the tour, or by another independent request of the interested party for a contract.

a. in the event that a tour corresponding to the Client’s request has already been firmly determined, the Travel Agency and the Client shall conclude a travel contract.

b. in the event that the Client requests individual services only for the Client or for a group represented by the Client, the Travel Agency will send him an offer of its services containing the services offered and a proposal for their price. After reaching an agreement on the scope and price of the services, the Travel Agency and the Client will conclude a travel contract.

c. If the Client requests a trip that is not firmly established, the interested party is included in the list of potential trip participants. If there is a real chance that the requested or similar trip will take place, the Travel Agency will provide the interested party with all available information about the planned trip and the documents for paying the deposit and its amount, and will ask the interested party to confirm their non-binding application and sign the travel contract.

2. If, after concluding the travel contract, the Client requests the provision of additional services, in particular optional trips, additional charges for additional services, additional charges for a single room, accommodation before or after the start of the Travel or other additional services, an amendment to the contract is agreed upon if an agreement is reached between the Client and the Travel Agency on the type of additional service and its price. In this case, after agreeing on their price and other conditions of provision, a confirmation corresponding to the circumstances of the conclusion will be given to the Client; if the agreement on additional services occurs before the start of the Travel, an amendment will be agreed upon to the travel contract in writing or by e-mail.

3. The Client is obliged to pay the additional charge for a single room in the amount specified in the Travel Contract, unless otherwise agreed, under the following conditions. In the event that the client as an individual participant remains odd, i.e. there is no other individual participant of the same sex on the list of clients participating in the Tour with whom he could share a double room, the Client is obliged to pay a surcharge for a single room.

4. The travel agency reserves the right, in the event that the number of clients does not reach the required minimum, the tour will not take place and the travel agency will return the deposits to the clients in full; the travel agency will notify the clients of this within the period agreed in the tour contract (otherwise no later than 1 month before the start of the tour), with this notification the contract will expire.

5. The travel agency further reserves the right to demand a fee for a small number of clients if the number of clients reaches the minimum for the tour to take place, but does not reach the standard required number, which is always stated with the amount of the surcharge for the number of participants in the Tour description. The Travel Agency may exercise the right to demand a fee for a small number of clients within the period agreed in the travel contract (otherwise no later than 1 month before the start of the trip).

6. If the circumstances of the trip require it, especially due to higher physical and/or mental demands, the travel agency is entitled to ask the Client to complete a short test and motivation paragraph before concluding the contract to verify that the requirements of the interested party match the focus of the relevant trip. If the travel agency recognizes that the requirements of the interested party do not match the focus of the trip, it will refuse to conclude the contract with justification.

7. If the Client, when concluding the travel contract, also agrees to a contract for other participants in the trip, he is always responsible for the fulfillment of this contract in relation to the travel agency and all legal regulations for these other persons.

8. If the Client is a person who is not fully capable of legal capacity, or if the participant of the trip is a person who is not fully capable of legal capacity and at the same time not all legal representatives of this person are not fully capable of legal capacity, it is the Client's obligation to ensure the consent of all legal representatives before departure in a form corresponding to the Czech legal system and the legal system of the place where the trip is organized. The travel agency is not liable for any damage caused by a violation of this provision, in particular by refusing to travel or cross the state border in the event that consent is not given to the departure of a person with limited legal capacity.

9. The contract between the Travel Agency and the Client is concluded in writing, or by means of distance communication. If the contract was concluded outside the premises of the Travel Agency, the Travel Agency will send all documents to the Client and to the specified e-mail address for record purposes.

10. After concluding the contract, the Client is considered to be a binding participant and the conditions for withdrawal from the contract according to Article III apply to him.

II. Rights and obligations of the parties

1. The Travel Agency is obliged to provide the Client with tour services at the agreed destination and on the agreed date.

2. The travel agency is entitled to use a representative (guide) to fulfill its obligations, but is nevertheless responsible for ensuring that the services are provided in comparable quality.

3. The travel agency is obliged to resolve any problems that arise according to its possibilities and abilities.

4. The client is obliged to pay the agreed prices for the tour and all optional trips that have been agreed.

5. The client participates in the tour at his own risk and responsibility, especially after considering his health condition, physical and mental capabilities and conditions in the destination. The client is hereby informed and instructed by the travel agency that tours are also organized to areas that are less politically or securityally stable than the Czech Republic, and the client acknowledges the resulting risks. The travel agency will inform the client of further details of the risks of the relevant tour.

6. The client is obliged to ensure quality travel insurance in case of illness and accident with a sufficient limit of financial coverage for participation in the tour. Luggage and liability insurance is also strongly recommended. If the client is not insured, the travel agency is not obliged to assist in resolving the consequences of insufficient insurance.

7. The client is obliged to follow the instructions of the travel agency and/or guide and be considerate towards other clients. The client must take into account the necessity of adapting some of his wishes and requirements to the needs of the group and the local cultural and political conditions at the place of the tour.

8. The travel agency is obliged to provide assistance if the client finds himself in difficulty. If possible, the client is obliged to communicate the need for assistance in a timely manner.

9. The travel agency is entitled, based on its own decision, to change or terminate the agreed tour program or part of it in cases where this is required to protect the life, health or property of any client, third parties, the travel agency or guide, or if this is necessary as a result of a decision by public authorities. The Travel Agency further reserves the right to change the program, date, location of the Trip and/or the mode of transport or other essential characteristics, if this is caused by circumstances beyond the control of the Travel Agency that make it impossible to comply with the program, date, location of the Trip and/or the mode of transport, especially if compliance with the agreed characteristics would endanger the Client or other participants in the Trip. The Travel Agency will always make every effort - unless the Contract is withdrawn under these conditions - to ensure that the replacement performance is equivalent in value to the originally agreed one; if this is not possible, it will compensate the Client for any difference in money.

10. If a substantial change occurs before the start of the Trip, the Client has the right to withdraw from the contract and has the right to a refund of the price of the Trip; if a substantial change occurs during the Trip, in the event of withdrawal from the contract, the participant has the right to a refund of only those costs that have not yet been irrevocably paid.

11. Due to the specific character of the Trip, Client takes note that order of places visited during the Trip, any light conditions, specific scenes photographed and details governing the photography are nature- and weather-dependent, and is therefore subject to change without prior notice. Travel Agency will take all realistically feasible steps to mitigate the effects of this nature-dependent fact on the Tour. Client is not entitled to a withdrawal from the contract nor to any discount is the Tour or its content is influenced by the weather and light conditions.

12. The tour program may only be set out in outline before the start of the tour, and the Client will be informed of this. The Client respects that, given the nature and destination of such a tour, a certain spontaneity in the formation of the program during the tour is inevitable (and in principle desirable). The Client also agrees to substantial changes to the program if the travel agency or guide decides to do so for legitimate reasons, or if the majority of clients are in favor of changing the program.

13. The tour price may only be increased in the event of a specific increase in costs (for example, fuel prices, but especially accommodation and transport prices) and if this is expressly stipulated in the tour contract, no later than 20 days before the start of the tour. If the price increase exceeds 8% of the tour price, the Client may withdraw from the contract. If the Travel Agency reserves the right to increase the price of the tour in the Tour Contract, the Client has the right to a discount on the price of the tour in the event of a reduction in the relevant costs

14. If the Client believes that the Tour suffers from defects, he is obliged to inform the Travel Agency or the relevant guide of this fact without delay (however always during the Tour) and thus enable a remedy to be arranged. The Travel Agency is not liable for any damage that may arise from breach of this obligation to point out the defect without delay.

15. The fact that the client does not use some or all of the Tour services or their parts does not entitle him to a discount on the agreed price of the services.

III. Tour price, withdrawal from the contract and severance pay

1. In the event of cancellation of the tour because the number of clients does not reach the required minimum, or in cases of force majeure (especially political or security conditions in the destination), the travel agency is obliged to refund the agreed price of the tour to the client.

2. The travel agency is also entitled to withdraw from the contract at any time during the tour if the client fails to comply with the obligation under the contract, especially if he consistently shows signs of recklessness towards the travel agency, local laws or customs, the guide or other clients. In such a case, the client is not entitled to a refund of the agreed price of the tour.

3. The client is obliged to make the first deposit for the tour price. The amount of the deposit is the amounts stated below, unless otherwise agreed in the tour contract, namely a deposit of 35% of the agreed price, payable no later than 10 days from the date of conclusion of the contract. The balance is payable 120 days before the first day of the tour, based on the Travel Agency's call no later than 10 days from the date of delivery of the Travel Agency's call. The client has the right to withdraw from the contract for any reason or without giving a reason before the start of the provision of guide services. However, he is obliged to pay (unless otherwise stipulated by other provisions of the contract or law):

a) a severance pay of 35% of the Tour price in the event that the client announces his withdrawal 121 or more days before the start of the tour. This termination fee corresponds to the amount of the first deposit (reservation fee), and the reservation fee is therefore non-refundable.

b) a severance pay of 60% of the agreed price if the cancellation is notified at least 91 days before the start of the Tour and less than 121 days before its start. The amount of the severance pay is negotiated with regard to the need to cover most of the costs of transport and accommodation within this period.

c) a severance pay of 100% of the agreed price if the cancellation is made later than 90 days before the start of the Tour. The amount of the severance pay is negotiated with regard to the need to cover almost all costs of the Tour, including personnel costs, in advance within this period.

With regard to the agreed severance pay, clients are strongly advised to take out trip cancellation insurance with an insurance company at the latest at the same time as concluding the Tour contract.

4. In the case of a private/private expedition, the client is obliged to pay a severance pay of 100% of the agreed price if the client does not find a suitable replacement for the client who is withdrawing. In the case of a private/private expedition, the deposit is 100% of the agreed price and is payable according to the previous paragraph.

5. In the event of a breach of the Client's obligation to pay the payable price of the Trip or part thereof no later than 10 days from the Travel Agency's call, the Travel Agency is entitled to withdraw from the Contract and demand a contractual penalty in the amount of the termination fee agreed in the Contract and these terms and conditions.

6. All payments to the Travel Agency can be made by bank transfer or payment card, and are charged in EUR. Conversion from another currency will be made according to the exchange rate charged by the Travel Agency's bank on the day of payment (i.e. the amount paid will be credited according to the amount credited to the Travel Agency's account). To ensure that the total amount paid by the Client corresponds to the contractual price of the Trip in EUR, the remaining balance shall be adjusted so that the sum of all payments made by the Client equals the agreed EUR price. If the exchange rate differs between the payment of the deposit and the payment of the remaining balance, the Travel Agency shall be entitled to adjust the amount of the balance accordingly.

7. The Client is entitled to transfer the Trip to a third party (substitute) no later than 14 days before the first day of the Trip, provided that the substitute agrees to this transfer and pays the unpaid part of the Trip price and the transfer fee no later than the notification of the transfer. An administrative fee of EUR 150 is charged for the transfer.

8. Unless the parties agree otherwise in writing, a change of date and/or destination requested by the Client is a requirement for withdrawal from the Trip Contract by the Client, and the termination fee agreed in the Contract and these terms and conditions shall apply.

9. If the client is a consumer and the contract was concluded outside the travel agency's premises, the client has the right, in accordance with Section 1829 of the Civil Code, to withdraw from the contract without giving any reason in writing by letter or by submitting the form attached to this contract (the use of the form is not mandatory), but always to the Travel Agency's address stated in the header within 14 days of the date of signing this contract. The deadline is met if the submission is sent on the last day of the deadline. If the Client withdraws from this contract in accordance with this provision, the Travel Agency shall refund all payments under this contract without undue delay, no later than 14 days from the date of receipt of the notice of withdrawal from the contract. If the Trip is to begin less than 14 days from the date of signing this contract, the Client requests that the Travel Agency begin performing the contract no later than the first day of the Trip; in such a case, upon withdrawal, funds for services already consumed or paid by the Travel Agency to third parties will not be refunded.

10. Transferring the paid price of the Trip or part thereof to the price of another Trip is possible only in the event of an agreement between the Travel Agency and the Client, and in exceptional cases depending on the circumstances, the availability of the tours and the reasons for this request of the client.

IV. Compensation for damage

1. The travel agency is not liable for damage to life, health or property caused during the expedition by other service providers, a third party or an extraordinary unforeseen and insurmountable obstacle arising independently of the will of the travel agency.

2. The client is obliged to act in such a way as to avoid damage to himself, other clients, the travel agency, the guide or third parties.

3. The travel agency's liability and all obligation to compensate for any material and non-material damage is limited in its total to the amount of the agreed price of the Tour services.

4. Travel agency CK Matkali s.r.o. has secured bankruptcy protection in the form of insurance with the entity UNIQA pojišťovna, a.s. Company ID: 49240480, registered office at Evropská 810/136, 160 12, Prague 6, info@uniqa.cz, www.uniqa.cz, +420 488 125 125, insurance policy number 1357526304.The scope of the insurance coverage includes the refund of the paid price of the Trip or its part, the refund of a proportional part of the Trip price in the event that the Trip is shortened due to the bankruptcy of the Travel Agency, and the necessary costs associated with arranging the Client’s return if required due to such bankruptcy. International flights are not included in the Trip and are arranged independently by the Client; therefore, the insurance does not cover the cost of such flights.

V. Other provisions

1. The relations established by the tour contract, including relations related to it or based on it, including any compensation for damage, are governed exclusively by Czech law.

2. The contracting parties have agreed that any disputes arising from the travel contract, its performance or breach, including relationships related to it or based on it, including any compensation for damage, will be decided by Czech courts, exclusively the District Court for Prague 10, if the legal regulations in the relevant case allow the choice of court.

These terms and conditions are effective from December 8, 2025. The right is reserved to amend or change these terms and conditions if necessary and to notify the Client of the changes at least 1 month in advance; in such a case, the Client is entitled to terminate the contract within 1 month, or the new general contractual terms and conditions in this notified version are binding on him.
